Guideline for vehicle recalls brings legal certainty

China

Dialogue Matters

In China, suppliers and manufacturers are subject to regulations concerning vehicle recalls. They must inform Chinese authorities directly of any product non-conformities. Until late 2020, however, it was unclear as to who should comply with this obligation in individual cases – the vehicle manufacturers or the suppliers? This led to considerable legal uncertainty for the companies affected. So GPQI brought together experts from German companies and the Chinese regulatory authorities. Together they developed a guideline for the reporting process which was adopted by the Chinese authorities and published as a global association standard by the German Association of the Automotive Industry (Verband der Automobilindustrie e.V. - VDA). This has now provided clarity for the automotive industry.
